Agreement and Acceptance
Please carefully review these Terms and Conditions ("Terms", "Terms and Conditions") before using the InnerGlow mobile application (the "Service") provided by Dragon Wings Enterprise LLC ("us", "we", or "our"). Your access to and use of the Service is subject to your acceptance and compliance with these Terms. These Terms apply to all visitors, users, and others who want to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you are not allowed to access the Service.
Privacy Policy
For information regarding the collection, use, and disclosure of user information, please refer to our Privacy Policy. Your use of the Services is subject to the terms outlined in our Privacy Policy.
Changes to Terms or Services
At our sole discretion, we may modify the Terms at any time. If any modifications are made, we will notify you by posting the updated Terms on the Site or through other means of communication. It is important for you to regularly review the Terms as your continued use of the Services after any modifications indicates your acceptance of the updated Terms. If you do not agree to the modified Terms, you are no longer authorized to use the app.
As the Services may evolve over time, we reserve the right to change or discontinue any part of the Services, with or without notice.
Communication
By creating an account on our service, you consent to subscribe to newsletters, marketing or promotional materials, push notifications and other information that we may send. However, you have the option to unsubscribe from receiving any or all of these communications from us by following the unsubscribe link or instructions provided in any email we send.
Subscriptions
Certain features of the InnerGlow app require a subscription ("Subscription(s)"). You will be charged in advance on a recurring basis ("Billing Cycle"). The billing cycles are set on annual basis, or lifetime depending on the subscription plan you choose when purchasing a Subscription. At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it or Dragon Wings Enterprise LLC cancels it. You can cancel the renewal of your Subscription directly on InnerGlow app or by contacting the Dragon Wings Enterprise LLC customer support team at [email protected].
To process the payment for your Subscription, you must provide accurate and complete billing information, including your full name, address, state, zip code, telephone number, and a valid payment method such as a credit card or PayPal. By submitting this payment information, you authorize Dragon Wings Enterprise LLC to charge all Subscription fees incurred through your account to the provided payment method. If automatic billing fails for any reason, Dragon Wings Enterprise LLC will send you an electronic invoice notifying you that you must manually arrange for the full payment within a specified deadline mentioned on the invoice.
Free Trial
Dragon Wings Enterprise may, at its discretion, offer a limited-time free trial for a Subscription ("Free Trial"). To sign up for the Free Trial, you may be required to provide your billing information. If you do provide your billing information during the Free Trial sign-up, you will not be charged by Dragon Wings Enterprise LLC until the Free Trial period expires. On the last day of the Free Trial, unless you have canceled your Subscription, you will be automatically charged the appropriate Subscription fees for the selected Subscription type. Dragon Wings Enterprise LLC reserves the right to modify the terms and conditions of the Free Trial offer or cancel the Free Trial offer without notice.
Changes in Subscription Fees
Dragon Wings Enterprise LLC, at its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any changes to Subscription fees will take effect at the end of the current Billing Cycle. Dragon Wings Enterprise LLC will provide you with reasonable advance notice of any changes in Subscription fees, giving you the opportunity to cancel your Subscription before the new fees take effect. If you continue to use the Service after the modification of Subscription fees, you are agreeing to pay the revised Subscription fee amount.
Refunds
Dragon Wings Enterprise LLC may consider certain requests for refunds of Subscriptions on a case-by-case basis, and refunds will be granted at the sole discretion of Dragon Wings Enterprise LLC.
Content and Content Rights
For the purpose of the InnerGlow app Terms of Use, (i) "Content" refers to text, graphics, images, music, software, audio, video, creative works, and any other materials that are made available through the Services, including User Content; and (ii) "User Content" refers to any Content provided by users, including yourself, to be made available through the Services.
Ownership of Content
Dragon Wings Enterprise LLC does not assert ownership rights over any User Content, and these Terms do not limit your rights to use and exploit your own User Content. However, Dragon Wings Enterprise LLC and its licensors exclusively retain all rights, titles, and interests in the Services and Content, including associated intellectual property rights. You agree that the Services and Content are protected by copyright, trademark, and other applicable laws in the United States and foreign countries. You agree not to alter, remove, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Services or Content.
Rights in User Content Granted by You
By making any User Content available through the InnerGlow app, you hereby grant Dragon Wings Enterprise LLC a non-exclusive, transferable, sublicensable, worldwide, royalty-free license to use, copy, modify, create derivative works based upon, distribute, publicly display, publicly perform, and distribute your User Content. This license is granted for the purpose of operating and providing the InnerGlow app and its Content to you and other users.
Rights in Content Granted by Dragon Wings Enterprise
Subject to your compliance with these Terms, Dragon Wings Enterprise LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download, view, copy, and display the Content within the InnerGlow app. This license is granted solely for your personal and non-commercial use, and only in connection with your authorized use of the InnerGlow app.
Registration and Your Information
To access certain features of the InnerGlow app, you must create an account ("Account"). You can create an Account through the app or website or via a third-party social networking service ("SNS Account") like Facebook. If you use the SNS Account option, we will gather personal information like your name, email address, and other information your privacy settings permit us to access from your SNS Account to create your InnerGlow app Account.
Accounts
It's essential that you provide us with accurate, complete, and current information for your Account and commit to keeping it up to date as necessary. If you don't, we may suspend or terminate your Account.
It is also your responsibility to maintain the confidentiality of your account and password. This includes restricting access to your computer and/or account. You agree to take responsibility for any activities or actions that occur under your account and/or password, regardless of whether the password is used on our Service or on a third-party service, even if you are unaware of them. If you become aware of any security breaches or unauthorized use of your account, you must notify us immediately.
When choosing a username, you may not use the name of another person or entity, or a name or trademark that is not lawfully available for use unless you have proper authorization. Additionally, you may not use a username that is offensive, vulgar, or obscene.
Using the Services
You acknowledge and accept that the Services, Products, and any other information provided through InnerGlow app are not meant, created, or intended to diagnose, prevent, or treat any diseases or medical conditions, or act as a substitute for professional medical care. Also, not all activities mentioned on the Services or Products are suitable for everyone. Refrain from using the Services while operating heavy machinery, driving, or performing other tasks that require attention and focus. You acknowledge and agree that you are solely responsible for your use of the Services.
Copyright Policy
We highly value and respect the intellectual property rights of others. Our commitment is to promptly address any claims of copyright or intellectual property infringement ("Infringement") regarding Content posted on our Service.
If you are the rightful owner of a copyrighted work or authorized on behalf of the owner, and you believe that your copyrighted work has been copied in a manner that constitutes copyright infringement, we request that you submit a claim via email to [email protected]. Please use the subject line "Copyright Infringement" and provide a detailed description of the alleged infringement as outlined in the "DMCA Notice and Procedure for Copyright Infringement Claims" below. Please be aware that making false claims or acting in bad faith regarding the infringement of any Content on our Service may result in you being held accountable for damages, including costs and attorney fees.

Infringement Claims
If you believe that your copyright has been infringed, you have the option to submit a notification in accordance with the Digital Millennium Copyright Act (DMCA). To do so, please provide our Copyright Agent with the following written information (see 17 U.S.C 512(c)(3) for more details):
An electronic or physical signature of the person authorized to act on behalf of the copyright owner.
A description of the copyrighted work that you claim has been infringed, including the URL or web page address where the copyrighted work can be found, or a copy of the copyrighted work.
Identification of the specific location on the InnerGlow app where the material you believe infringes your copyrighted work is located.
Your contact information, including your address, telephone number, and email address.
A statement from you stating that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
A statement made under penalty of perjury that the above information in your notice is accurate, and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Intellectual Property
The InnerGlow app and all original content that is not user-generated, features, and functions are the sole property of The Dragon Wings Enterprise LLC and its licensors, and will remain as such. The app is protected by copyright, trademark, and other laws in both the United States and foreign countries. You may not use our trademarks and trade dress in connection with any product or service without our prior written consent.
Links to Other Websites
The InnerGlow app may contain links to third-party websites or services that are not owned or controlled by The Dragon Wings LLC. We do not have control over the content, privacy policies, or practices of any third-party websites or services. We also do not endorse the offerings of any entities, individuals, or their websites. By using the InnerGlow app, you agree to hold The Dragon Wings LLC harmless for any damage or loss that may be caused by or in connection with the use of or reliance on any content, goods, or services offered by any such third-party websites or services.
It is strongly advised that you read the terms and conditions as well as privacy policies of any third-party websites or services that you visit.
Termination
Dragon Wings Enterprise LLC retains the right to terminate or suspend your account, along with access to the InnerGlow app, immediately and without prior notice or liability under our discretion and for whatever reason, including but not limited to a breach of our terms. You may terminate your account whenever you wish by simply discontinuing the use of the InnerGlow app.
All provisions of these terms that require continued observance after account termination will continue, including, but not limited to, ownership provisions, warranty and liability disclaimers, and indemnity.
Indemnification
By using the InnerGlow app, you agree to defend, indemnify, and hold harmless Dragon Wings Enterprise LLC, its licensees, licensors, employees, contractors, agents, officers, and directors from any and all claims, damages, obligations, losses, liabilities, costs, or debts, including attorney's fees, that may arise from a) your use and access of the app, as well as the use of your account and password by any person; b) any breaches of these Terms; or c) any content posted on the app.
Limitation of Liability
In no event shall Dragon Wings Enterprise LLC, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses. This includes damages resulting from:
Your access to or use of the app.
Conduct or content of any third party on the app.
Content obtained from the app.
Unauthorized access, use, or alteration of your transmissions or content.
These limitations apply whether such damages are based on warranty, contract, tort (including negligence), or any other legal theory, even if Dragon Wings Enterprise LLC has been informed of the possibility of such damages. Even if a remedy mentioned in these terms fails to achieve its essential purpose, this limitation of liability still stands.
Disclaimer
Your use of the InnerGlow app is entirely at your own risk. The app is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, whether express or implied. Dragon Wings Enterprise LLC, its subsidiaries, affiliates, and licensors do not guarantee that the app will function uninterrupted, be secure, available at any specific time or location, or free from viruses or other harmful components. Furthermore, they do not warrant that any errors or defects in the app will be corrected, or that the results obtained from using the app will meet your specific requirements.
Exclusions
Please note that some jurisdictions may not permit the exclusion of certain warranties, or the exclusion or limitation of liability for consequential or incidental damages. Therefore, the above limitations may not apply to you.
Governing Law
The Terms of Use for the InnerGlow app shall be governed and construed according to the laws of California, United States, disregarding any conflicts of law provisions. If any provision of these Terms is deemed invalid or unenforceable by a court, the remaining provisions will still hold their effect. Failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. These Terms constitute the complete agreement between you and Dragon Wings Enterprise LLC regarding the use of the InnerGlow app and supersede any prior agreements or discussions concerning the app.
